Billing and Payments

The purchase price for products and services is payable in full before delivery. We accept the following credit cards at this time: Visa, MasterCard, American Express, or Discover.

We use a third party payment service in lieu of directly processing your credit card information. By submitting your credit card information, you grant TrueLight the right to store and process your information with the third party payment service, which it may change from time to time; you agree that TrueLight will not be responsible for any failures of the third party to adequately protect such information. All financial matters regarding your information are subject to the conditions of the third party payment service provider’s terms of service. You acknowledge that we may change the third party payment service and move your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.

Shipping and Risk of Loss

Low, flat rate shipping and handling fees are added to your cart at the time of checkout. Shipping dates and/or arrival times are only estimates. For loss/damage claims, you must notify TrueLight within 30 days of the date of your purchase if you believe all or part of your order is missing or damaged.

Replacement of products and credits to your account for shipped merchandise claimed as not received are subject to our investigation, which may include postal-service notification. We will adjust your account at our discretion. Repeated claims of undelivered merchandise may result in the cancellation of your account.

Returns and Exchanges

If a product is defective upon receipt, you may return it within thirty (30) days of receipt and we will send you a new item or credit your account. To request a refund or replacement, please contact us at info@shoptruelight.com. When returning products, it is your responsibility to take reasonable care to see that the products are not damaged in transit and are received by us at our address as displayed on the Website. Refunds are at the sole discretion of TrueLight.com.

Local Taxes and Import Duties

You may be charged local sales tax, import duties and/or VAT, if applicable. Import duties and VAT are not included in the cost of international shipments and you may be charged by the carrier separately prior to delivery. You are responsible for paying the cost of any import duties or any other taxes/fees as required by law.

(b) NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, (i) IN NO EVENT WILL BIOHACKED OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES  BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, UNDER ANY CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, REVENUE OR SAVINGS, OR THE LOSS OF USE OF ANY DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. You agree to indemnify, defend and hold harmless TrueLight and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Disputes

Any controversy between the parties arising out of this Agreement shall be submitted to the Judicial Arbitration and Mediation services for arbitration in Seattle, Washington, using one arbitrator. The costs of the arbitration, including any administration fees, the arbitrator’s fee, and costs for the use of facilities during the hearings, shall be borne equally by the parties to the arbitration. The arbitrator shall not have any power to alter, amend, modify or change any of the terms of this Agreement nor to grant any remedy which is either prohibited by the terms of this Agreement, or not available in a court of law. BY AGREEING TO THESE TERMS OF SERVICE, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO HAVE A COURT HEAR CLAIM ARISING IN CONNECTION WITH THIS AGREEMENT, AMONG OTHER WAIVERS OF RIGHTS SET FORTH IN THIS AGREEMENT.

These Terms and Conditions constitute the entire agreement between the parties relating to the subject matter herein. We may, at our sole discretion and without notice, revise these terms at any time by updating this posting.

Minors

TrueLight services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. Individuals under the age of 18 can use this service only in conjunction with and under the supervision of a parent or legal guardian. In this case, the adult is the user and is responsible for any and all activities, subscribers and purchasers.

Intellectual Property Rights

TrueLight may terminate these Terms and Conditions upon electronic communication of a notice of termination to Customer. These Terms and Conditions may not be amended except by TrueLight.  Any determination of invalidity or unenforceability of any one provision will have no effect on the continuing force and effect of the remaining provisions. These Terms and Conditions shall be governed by the laws of the State of Washington. Customer may not assign its rights and obligations under these Terms and Conditions without the consent of TrueLight.

Terms Specific to TrueDark Daylights and Twilight Glasses

The statements about TrueDark Daylights and TrueDark Twilight have not been evaluated by the FDA (U.S. Food & Drug Administration). Information provided here and products sold on TrueDark.com are not intended to diagnose, treat, cure, or prevent any disease. The information provided by these sites and/or by this report is not a substitute for a face-to-face consultation with your physician, and should not be construed as medical advice of any sort. We offer a 100% satisfaction guarantee on TrueDark Daylights and Twilight glasses and case. Email support@truedark.com if you’d like to return TrueDark glasses within 90 days of purchase. The customer is responsible for outbound and return shipping costs.

TrueDark® warrants that this product will be free from defects in materials and workmanship for 1 year from the date of purchase by the original owner. The customer is responsible for outbound and return shipping costs. This warranty covers the original purchaser only and is not assignable or transferable to another party. Warranty is void if the device is used for commercial use or disassembled at any point.
